The Ministry of Information and Broadcasting issues advisory to social media influencers regarding the endorsement of offshore betting and gambling platforms. As per Business Today’s report, the advisory states the potential consequences for those failing to comply, including proceeding under the provision of the Consumers Act, 2019. The decision has been implemented regarding the growing concern about the financial and socio-economic impact of online betting and gambling on youth.
The Government has decided to remove or disable those accounts or posts that contain online gambling promotions along with disciplinary action under applicable law. The advisory highlights that subsection (3)(b) of Section 79 of the IT Act 2000 provides an exemption of liability for third-party information. This exemption is inapplicable to intermediaries who practice unlawful acts upon receiving actual information or knowledge from the appropriate government and agencies.
CCPA’s Concern Regarding Endorsement Of Gambling And Betting Platforms By Celebrities
In recent times, it has been observed that many social media influencers and celebrities have appeared in ads for illegal betting apps. They were even promoting on personal social media platforms or handles. The CCPA (Central Consumer Protection Authority) has expressed deep concern regarding endorsements of gambling and betting platforms through celebrities.
CCPA warns that strict action will be taken against influencers who are involved in direct or indirect endorsements or advertisements that violate the advisory. The report also states that many celebrities are currently under investigation for promoting apps like FairPlay, the subsidiary of the illegal Mahadev Book App. The social media intermediaries are also advised to conduct sensitization efforts among their users to discourage the publication of such content.
